Please read these Terms of Service carefully before using ProMow. By creating an account or using the ProMow application, you agree to be bound by these Terms. If you do not agree, do not use the app.
ProMow ("the App", "we", "us", "our") is a smart round management platform designed for independent lawn mowing operators. ProMow is operated by Thomas Kendall (ABN: 35 045 375 610), trading as ProMow, an Australian business based at 85 Pembrey Loop, Cowes VIC 3922.
These Terms of Service ("Terms") govern your access to and use of the ProMow application, including all features such as quoting, scheduling, invoicing, client management, round health analysis, and the ProMow Marketplace.
By using ProMow, you confirm that you:
- Are at least 18 years of age
- Are operating as a sole trader, partnership, or business entity in Australia
- Are using the App for lawful business purposes related to lawn mowing or garden maintenance services
- Have the legal authority to enter into these Terms on behalf of yourself or your business
To use ProMow, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately at hello@promow.app if you suspect any unauthorised use of your account
We reserve the right to suspend or terminate accounts that contain false or misleading information, or that are used in violation of these Terms.
ProMow is currently available free of charge during an initial launch period ("Free Period"). We will provide at least 30 days' written notice via email or in-app notification before transitioning to a paid subscription model.
Following the Free Period, continued access to ProMow will require a paid subscription. The current planned subscription fee is AUD $30.00 per month per operator account. This fee is subject to change, and users will be given at least 30 days' notice of any price changes.
- Subscriptions will be billed monthly in advance
- Payments will be processed via a third-party payment provider
- Subscription fees are non-refundable except where required by Australian Consumer Law
- Failure to pay may result in suspension or termination of your account
You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. Your data will be retained for 60 days post-cancellation, after which it may be permanently deleted.
You agree to use ProMow only for lawful purposes. You must not:
- Use the App to send unsolicited commercial communications (spam) to your clients
- Enter false, misleading, or fraudulent information into the App
- Attempt to access, tamper with, or disrupt the App's servers or infrastructure
- Reverse engineer, copy, or reproduce any part of the App
- Use the App to facilitate any illegal activity
- Harass, threaten, or abuse other ProMow users
- Create multiple accounts to circumvent suspensions or bans
The ProMow Marketplace allows operators to list lawn mowing jobs for sale and to acquire jobs listed by other operators. The Marketplace is designed to help operators optimise their service rounds by trading inefficient jobs for better-located work.
ProMow reserves the right to determine marketplace eligibility based on account standing. We may review your account data — including job completion history, invoicing records, and payment tracking data — to assess suitability.
- You warrant that the job is genuine and that you have the right to transfer or assign it
- Listing information must be accurate, including location, price, and frequency
- ProMow does not guarantee that listed jobs will be purchased or that browsed jobs will be available
ProMow facilitates connections between operators but is not a party to any job transfer agreement between operators. Any disputes arising from Marketplace transactions are between the operators involved. ProMow accepts no liability for losses arising from Marketplace transactions.
You retain ownership of all data you enter into ProMow, including client records, job history, invoices, and business information. By using ProMow, you grant us a limited, non-exclusive licence to store, process, and display your data solely for the purpose of providing the App's services.
As an operator, you are solely responsible for ensuring that you have the necessary consents and authority to enter your clients' personal information into ProMow. You must comply with all applicable privacy laws when collecting, storing, and communicating with your clients through the App.
On account cancellation or termination, your data will be retained for 60 days before deletion. You may request an export of your data at any time by contacting hello@promow.app.
ProMow provides tools to help you create and send invoices to your clients. You acknowledge that:
- ProMow does not process payments between you and your clients — it is an invoicing management tool only
- ProMow does not store credit card or bank account details
- You are solely responsible for the accuracy of invoices you generate and send through the App
- ProMow is not liable for unpaid invoices or payment disputes between you and your clients
- You must comply with Australian taxation laws regarding invoicing and GST where applicable
ProMow may send quotes, invoices, and reminders to your clients via SMS and email on your behalf. By using this feature, you confirm that:
- You have obtained appropriate consent from your clients to receive electronic communications
- You will not use ProMow to send communications that are misleading, offensive, or unsolicited
- You comply with the Spam Act 2003 (Cth) and the Telecommunications Act 1997 (Cth)
ProMow is not liable for any claims arising from communications sent by operators through the App.
All intellectual property rights in the ProMow application, including its design, code, branding, features, and content created by us, are owned by or licensed to ProMow. Nothing in these Terms transfers any intellectual property rights to you.
You may not copy, reproduce, distribute, modify, or create derivative works of any part of the App without our prior written consent.
ProMow provides tools to assist with round management, pricing, and scheduling. We make no guarantee that use of the App will result in increased revenue, business growth, or any specific business outcome. Pricing suggestions and round health assessments are indicative only.
We aim to make ProMow available at all times but do not guarantee uninterrupted access. The App may be unavailable due to maintenance, updates, or circumstances beyond our control.
To the maximum extent permitted by Australian law, ProMow's total liability to you for any claim arising from your use of the App is limited to the amount you paid us in subscription fees in the three months preceding the claim. We are not liable for any indirect, consequential, incidental, or special damages.
Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified by agreement.
We may suspend or terminate your account, with or without notice, if:
- You breach any of these Terms
- We reasonably suspect fraudulent, abusive, or illegal activity
- You fail to pay subscription fees when due (once billing commences)
- We discontinue the ProMow service
You may terminate your account at any time by contacting us at hello@promow.app or using the account deletion function within the App.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising from these Terms or your use of ProMow will be subject to the exclusive jurisdiction of the courts of Victoria.
Before initiating legal proceedings, you agree to contact us at hello@promow.app and give us a reasonable opportunity (no less than 14 days) to resolve the dispute informally.
